1. Acceptance of Terms

By accessing or using TurnToVideo (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

TurnToVideo is a web-based service that allows users to upload photos and transform them into videos using AI technology. The Service includes:

  • Free video creation with watermarked previews
  • Paid downloads of watermark-free videos in various quality tiers
  • Classic (Ken Burns) and AI-powered video generation modes

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion.

4. User Content

4.1 Your Content

You retain ownership of all photos and content you upload to the Service (“User Content”). By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service.

4.2 Content Restrictions

You agree not to upload content that:

  • Infringes on any third party's intellectual property rights
  • Contains illegal, harmful, threatening, abusive, or defamatory material
  • Contains explicit or pornographic content
  • Contains personal information of others without consent
  • Violates any applicable laws or regulations
  • Contains malware, viruses, or harmful code

4.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of any User Content and are not liable for any User Content uploaded by users.

4.4 AI Content Limitations

Our AI video generation may reject certain content due to safety filters (e.g., celebrity detection). This is a feature of the underlying AI technology and is not within our control. In such cases, you may use the Classic generation mode as an alternative.

5. Purchases and Payments

5.1 Pricing

TurnToVideo offers one-time purchases for video downloads. Current pricing is displayed on the Service and may change at any time. Prices are in USD unless otherwise stated.

5.2 Payment Processing

Payments are processed through Lemon Squeezy. By making a purchase, you agree to Lemon Squeezy's terms of service and privacy policy.

5.3 Refunds

Due to the digital nature of our products, we generally do not offer refunds once a video has been downloaded. However, if you experience technical issues that prevent you from receiving your purchased content, please contact us and we will work to resolve the issue or provide a refund.

5.4 Download Availability

Purchased videos are available for download for one (1) year from the date of purchase. We recommend downloading your videos promptly after purchase.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by TurnToVideo and is protected by copyright, trademark, and other intellectual property laws.

6.2 Generated Videos

Videos generated from your photos are owned by you, subject to any licenses you have granted to us. You are free to use, share, and distribute your generated videos as you see fit.

7. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service
  • Circumvent or attempt to circumvent any security measures
  • Resell or redistribute the Service without authorization
  • Use the Service to generate content that violates these Terms

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee specific results from the AI video generation. Results may vary based on the quality and nature of uploaded photos.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNTOVIDEO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TurnToVideo and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the content, privacy policies, or practices of third-party services.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service or sending you an email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TurnToVideo operates, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TurnToVideo regarding your use of the Service.
